By using nosh, you agree to these terms.

1. License

nosh is open-source software licensed under the Apache License, Version 2.0. You may use, modify, and distribute nosh in accordance with that license. The full license text is available in the LICENSE file in the source repository.

These Terms of Use govern your use of the nosh Cloud service (AI translation, agentic mode, and related API services). The nosh shell itself is governed by the Apache 2.0 license.

2. Prohibited Use

You may not:

2.1 Abuse

Use nosh AI to generate spam, malware, harassment, or content for illegal activities.

2.2 Automated Abuse

Use bot farms, automated scripts, or other means to circumvent rate limits or abuse the service.

3. Accounts

You must provide a valid email address to create an account
You are responsible for maintaining the security of your account
Account sharing between individuals is permitted

4. Payments

Subscription fees are billed monthly in advance
Token packs are one-time purchases that never expire
Refunds are handled on a case-by-case basis

5. Service Availability

We strive for high availability but do not guarantee uninterrupted service. Free tier access may be limited when capacity is reached.

6. Termination

We may suspend or terminate accounts that violate these terms without refund. You may cancel your subscription at any time through the billing portal.

7. Disclaimer

nosh is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement.

AI-generated commands may be incorrect, incomplete, or dangerous. You are solely responsible for reviewing and understanding any command before execution. nosh includes safety mechanisms, but these mechanisms may not catch all potentially harmful commands.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall nosh, its creators, affiliates, or service providers be liable for:

Any direct, indirect, incidental, special, consequential, or punitive damages
Loss of data, profits, revenue, or business opportunities
Damages arising from AI-generated commands, including commands that bypass safety mechanisms
System damage, data loss, or security breaches resulting from executed commands
Any damages arising from your use or inability to use nosh

You use nosh entirely at your own risk. This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

9. Changes

We may update these terms from time to time. Continued use of nosh after changes constitutes acceptance of the new terms.
